Definitions

Meaningful Crafts s a trade name of De Witte Engel v.o.f. established in Den Burg (Texel), Wezenland 1, zip code 1791 AZ, and registered with the Chamber of Commerce in Alkmaar under number 52544648, VAT identification NL850492737B01. For detailed address details, see Contact us.

Customer: the customer who, whether or not acting in the exercise of a profession or business, enters into an Agreement with Meaningful Crafts.

Agreement: any agreement or agreement between Meaningful Crafts and the Customer, of which agreement the General Terms and Conditions form an integral part.

Article 1. Applicability of the General Terms and Conditions

1.1. The General Terms and Conditions apply to all offers, Agreements and deliveries of Meaningful Crafts, unless explicitly agreed otherwise in writing.

1.2. If the Client includes provisions or conditions that deviate from, or do not appear in, the General Terms and Conditions in its order, confirmation or notice of acceptance, these are only binding on Meaningful Crafts if and insofar as Meaningful Crafts have expressly accepted them in writing.

1.3. In the event that specific product or service conditions apply in addition to these General Terms and Conditions, those terms and conditions also apply, but in the event of conflicting terms and conditions, the Customer may always invoke the applicable provision that is most favorable to him.

Article 2. Prices and information

2.1. All prices stated on the Website and in other materials originating from Meaningful Crafts are, unless otherwise stated, including VAT and other levies imposed by the government.

2.2. If shipping costs are charged, this will be clearly stated in time for the conclusion of the Agreement. In addition, these costs will be shown separately in the ordering process on the Website.

2.3. The content of the Website has been compiled with the greatest care. However, Meaningful Crafts cannot guarantee that all information on the Website is accurate and complete at all times. All prices and other information on the Website and in other materials originating from Meaningful Crafts are therefore subject to obvious programming, calculation and typing errors.

2.4. Meaningful Crafts cannot be held responsible for (color) deviations due to screen and printing quality.

Article 3. Formation of the Agreement

3.1. The Agreement is concluded at the moment of acceptance by the Client of the offer of Meaningful Crafts and the fulfillment of the relevant conditions set by Meaningful Crafts.

3.2. If the Client has accepted the offer electronically, Meaningful Crafts will immediately confirm receipt of the acceptance of the offer electronically. As long as the receipt of this acceptance has not been confirmed, the Client has the option to terminate the Agreement.

3.3. If it turns out that incorrect information was provided by the Client when accepting or otherwise entering into the Agreement, Meaningful Crafts has the right to fulfill its obligation only after the correct information has been received.

3.4. Meaningful Crafts can inform itself within legal frameworks whether the Client can meet its payment obligations, but also of all facts and factors that are important for a responsible conclusion of the Agreement. If on the basis of this investigation Meaningful Crafts has good reasons not to enter into the Agreement, he is entitled to motivate to refuse an order or request or to attach special conditions, such as prepayment, to the implementation.

Article 4. Execution Agreement

4.1. As soon as the order has been received by Meaningful Crafts, Meaningful Crafts will send the products with due observance of the provisions of paragraph 3 of this Article as soon as possible.

4.2. Meaningful Crafts is entitled to engage third parties to perform the obligations arising from the Agreement.

4.3. The Website clearly describes, in time for the conclusion of the Agreement, the manner in which delivery will take place and within which period the products will be delivered. If no delivery period has been agreed or stated, products will in any case be delivered within 30 days.

4.4. If Meaningful Crafts cannot deliver the products within the agreed period, it will inform the Client thereof. In that case, the customer can agree to a new delivery date or he will be given the option to terminate the Agreement free of charge.

4.5. Meaningful Crafts recommends that the Customer inspect the delivered products and report any defects that have occurred within a reasonable time, preferably in writing. See further the Article regarding warranty and conformity.

4.6. As soon as the products to be delivered have been delivered to the specified delivery address, the risk with regard to these products will transfer to the Customer. If explicitly agreed otherwise, the risk is transferred to the Customer earlier. If the Customer decides to collect the products, the risk passes when the products are transferred.

4.7. Meaningful Crafts is entitled to deliver a similar product of similar quality as the ordered product, if the ordered is no longer available. Customer is then entitled to terminate the Agreement free of charge and to return the product free of charge.

Article 5. Right of withdrawal

5.1. This article only applies to the Client being a natural person who is not acting in the exercise of his profession or business.

5.2. Customer has the right to terminate the agreement with Meaningful Crafts concluded at a distance within 30 days after receipt of the product, without giving reasons, free of charge.

5.3. The period starts on the day after the Customer, or a third party designated by him in advance, who is not the carrier, has received the product, or:

if the Customer has ordered several products in the same order: the day on which the Customer, or a third party designated by him, has received the last product;

if the delivery of a product consists of different shipments or parts: the day on which the Customer, or a third party designated by him, received the last shipment or the last part;

for Agreements for regular delivery of products during a certain period: the day on which the Customer, or a third party designated by him, has received the first product.

5.4. Only the direct costs for the return shipment will be borne by the Customer. The customer must therefore bear the return costs himself. If these costs are higher than the regular postal rate, Meaningful Crafts provides an estimate of these costs. Any costs paid by the Customer for shipping and payment of the product to the Customer will be reimbursed to the Customer upon return of the entire order.

5.5. Within the withdrawal period referred to in paragraph 1, the Client will handle the product and the packaging with care. The customer will only open the package and use the product only to the extent necessary to ascertain the nature, characteristics and operation of products. The basic principle here is that this inspection may not go beyond what the Client could do in a physical store.

5.6. Customer is only liable for value reduction of the product that is the result of a way of handling the product that goes beyond what is permitted in the previous paragraph.

5.7. The Customer may terminate the Agreement in accordance with the period specified in paragraph 1 of this Article by sending the (model) form for withdrawal (digitally) to Meaningful Crafts, or in another unambiguous way informing Meaningful Crafts that he will cancel the purchase. . Meaningful Crafts confirms receipt of that report in the event of a digital report. After dissolution, the Client still has 14 days to return the product. It is also possible to immediately return the product within the cooling-off period specified in paragraph 1 of this Article, provided that the (model) form for cancellation or other unambiguous declaration for cancellation is included.

5.8. Amounts (already paid in advance) by the Customer will be reimbursed to the Customer as soon as possible, but no later than within 14 days after termination of the Agreement, in the same way that the Customer has paid for the order. If the Client has opted for a more expensive method of delivery than the cheapest standard delivery, Meaningful Crafts does not have to pay back the additional costs for the more expensive method. Unless Meaningful Crafts offers to collect the product itself, Meaningful Crafts may wait to repay until Meaningful Crafts has received the product or until Customer demonstrates that he has sent back the product, whichever is the earlier.

5.9. The Website clearly, timely before the conclusion of the Agreement, information about whether or not the right of withdrawal is applicable and any desired procedure is stated.

5.10. The right of withdrawal does not apply to:

Products created by the entrepreneur in accordance with the Customer’s specifications;

Individual newspapers and magazines;

Products for which the Customer has broken the seal;

Products that have been specially ordered for the Client and that fall outside the standard range or the usual stock of Meaningful Crafts in terms of dimensions and / or quantity.

Article 6. Payment

6.1. The customer must make payments to Meaningful Crafts in accordance with the payment methods indicated in the order procedure and possibly on the Website. Meaningful Crafts is free in the choice of offering payment methods and these may also change from time to time. In the event of payment after delivery, the Client has a payment period of 14 days starting on the day after delivery.

6.2. If the Customer does not meet his payment obligation (s) in time, he will be reminded of the late payment after Meaningful Crafts has been informed and Meaningful Crafts has granted the Customer a period of 14 days to meet his payment obligations. the absence of payment within this 14-day period, the statutory interest on the amount still owed and Meaningful Crafts is entitled to charge the extrajudicial collection costs incurred by him. These collection costs amount to a maximum of: 15% on outstanding amounts up to € 2,500; 10% over the following € 2,500 and 5% over the following € 5,000; with a minimum of € 40. Meaningful Crafts can, for the benefit of the Customer, deviate from the stated amounts and percentages.

Article 7. Warranty and conformity

7.1. This article only applies if there is a Customer who is not acting in the exercise of his profession or business. If a separate guarantee is given by Meaningful Crafts on the products, this applies to all types of Customers, without prejudice to the just stated.

7.2. Meaningful Crafts guarantees that the products comply with the Agreement, the specifications stated in the offer, the reasonable requirements of reliability and / or usability and the legal provisions and / or government regulations existing on the date of the conclusion of the Agreement. If specifically agreed, Meaningful Crafts also guarantees that the product is suitable for other than normal use.

7.3. If the delivered product does not comply with the Agreement, the Client must inform Meaningful Crafts within a reasonable period of time after it has discovered the defect.

7.4. If Meaningful Crafts considers the complaint to be justified, the relevant products will be repaired, replaced or reimbursed after consultation with the Customer. The maximum reimbursement, subject to the Article on liability, is equal to the price paid by the Customer for the product.

Article 8. Warranty for business purchases

8.1. Meaningful Crafts guarantees that the products comply with the Agreement, the specifications stated in the offer, the reasonable requirements of reliability and / or usability and the legal provisions and / or government regulations existing on the date of the conclusion of the Agreement. If specifically agreed, Meaningful Crafts also guarantees that the product is suitable for other than normal use. Otherwise, the product is suitable for normal use.

8.2. If the delivered product does not comply with the Agreement upon delivery, the Client must notify Meaningful Crafts within 8 days of delivery. If the Customer does not do this, he can no longer claim repair, replacement, etc. if the product has been delivered defectively.

8.3. If Meaningful Crafts considers the complaint to be justified, the relevant products will be repaired, replaced or (partially) reimbursed after consultation with the Customer.

Article 9. Complaints procedure

9.1. If the Customer has a complaint about a product (in accordance with Article 7 concerning warranty and conformity) and / or about other aspects of the services of Meaningful Crafts, he can submit a complaint to Meaningful Crafts by telephone, e-mail or by post. See the contact details at the bottom of the Terms and Conditions.

9.2. Meaningful Crafts gives the Client a response to his complaint as soon as possible, but in any case within 7 days after receiving the complaint. If it is not yet possible to give a substantive or definitive response, then Meaningful Crafts will confirm the complaint and give an indication of the period within which it expects to give a substantive or definitive response to the complaint within 7 days of receiving the complaint. complaint from Customer.

9.3. Customers who are not acting in the exercise of their profession or business can also submit a complaint via the European dispute settlement platform, accessible via http://ec.europa.eu/odr/.

Article 10. Liability

10.1. This Article only applies if the Client is a natural or legal person who is acting in the exercise of his profession or business.

10.2. The total liability of Meaningful Crafts towards the Customer due to imputable failure to comply with the Agreement is limited to reimbursement of a maximum of the amount stipulated for that Agreement (including VAT).

10.3. Liability of Meaningful Crafts towards Customer for indirect damage, including in any case – but explicitly not exclusively – consequential damage, lost profit, lost savings, loss of data and damage due to business interruption, is excluded.

10.4. Apart from the cases mentioned in the previous two paragraphs of this Article, Meaningful Crafts is not liable to the Client for any compensation, regardless of the basis on which an action for compensation would be based. The limitations referred to in this Article will, however, lapse if and insofar as damage is the result of intent or gross negligence on the part of Meaningful Crafts.

10.5. The liability of Meaningful Crafts towards the Customer due to imputable shortcoming in the fulfillment of an Agreement arises only if the Customer immediately and properly informs Meaningful Crafts in writing, stating thereby a reasonable period for clearing the shortcoming, and Meaningful Crafts also after that period in the performance. continues to fall short of its obligations. The notice of default must contain as detailed a description as possible of the shortcoming, so that Meaningful Crafts is able to respond adequately.

10.6. A condition for the existence of any right to compensation is always that the Customer reports the damage in writing to Meaningful Crafts as soon as possible, but at the latest within 30 days after its occurrence.

10.7. In the event of force majeure, Meaningful Crafts is not obliged to compensate for any damage caused thereby to the Customer.

Article 11. Retention of title for Business Purchases

11.1. As long as the Business Customer has not made a full payment for the entire agreed amount, all goods supplied remain the property of Meaningful Crafts.

Article 12. Personal data

12.1. Meaningful Crafts processes the personal data of the Customer in accordance with the privacy statement published on the Website.

Article 13. Final provisions

13.1. Dutch law applies to the Agreement.

13.2. Insofar as mandatory law does not prescribe otherwise, all disputes that may arise under the Agreement will be submitted to the competent Dutch court in the district where Meaningful Crafts is located.

13.3. If a provision in these General Terms and Conditions turns out to be invalid, this does not affect the validity of the entire General Terms and Conditions. The parties will in that case replace (a) new provision (s), which will give shape to the intention of the original provision as much as possible in law.

13.4. In these General Terms and Conditions, “written” also means communication by e-mail and fax, provided that the identity of the sender and the integrity of the e-mail are sufficiently established.
